ο ορισμός λοιπόν είναι άνευ ουσιαστικής σημασίας γιατί ούτως ή άλλως δεν υπάρχει πρόβλεψη υποχρέωσης παροχής αιτιολόγησης. παρόλαυτα, το πλησιέστερο σε "υποχρέωση αιτιολόγησης" που περιέχεται στο νόμο είναι η ίδια η επίκληση του κινδύνου για την εθνική ασφάλεια. το χαρτάκι δηλαδή που θα καλείται η εισαγγελέας να υπογράψει θα κάνει επίκληση σε κάποιον αόριστο κίνδυνο για την εθνική ασφάλεια, και μάλιστα θα σημειώνει "όπως αυτή ορίζεται στο νόμο".

Θα μπορούσε άραγε ο ορισμός από μόνος του να λειτουργήσει -σε όποιον βαθμό- ως αντίβαρο συνταγματικότητας και δημοκρατίας; Αν ήταν ακριβέστερος και περιείχε για παράδειγμα έναν κατάλογο με τους κινδύνους εναντίον της εθνικής ασφαλείας; λυπάμαι που ένας τόσο έγκριτος νομικός έχει απελπιστεί σε τέτοιο βαθμό που να μην καταλαβαίνει πως αυτός ο ορισμός σε λίγες μέρες θα είναι νόμος του κράτους και δεν θα τολμήσει κανείς να τον ξαναπειράξει. φτάσαμε μέχρι το 2022 χωρίς ποτέ να αναγκαστούν να ορίσουν την εθνική ασφάλεια σε χαρτί. το μόνο άρθρο που απασχολεί την κοινότητα των μυστικών υπηρεσιών είναι αυτός ο ορισμός.
